RESIDENTIAL TENANCY AGREEMENT

This Tenancy Agreement is entered into on 14 May 2026, between:

1. PREMISES
The Landlord hereby lets to the Tenant the property described as: ________________________, situated at ________________________ (hereinafter referred to as the "Premises").
2. TERM
This tenancy shall commence on ________________________ and shall continue on a month-to-month basis until terminated by either party with 30 days' written notice.
3. RENT
The Tenant shall pay rent of KES ___ (Kenyan Shillings ___) per month, payable on or before the 5th day of each month via M-Pesa. Rent paid after the due date shall attract a late fee of 5% of the monthly rent.
4. SECURITY DEPOSIT
The Tenant shall pay a refundable security deposit of KES ___ upon signing this Agreement. The deposit shall be refunded within 30 days of the Tenant vacating the Premises, less any deductions for unpaid rent or damage beyond fair wear and tear.
5. UTILITIES
All utility costs including water, electricity, and internet shall be the sole responsibility of the Tenant.
6. USE OF PREMISES
The Tenant shall use the Premises solely for residential purposes. The Tenant shall not sublet, assign, or part with possession of the Premises without the prior written consent of the Landlord.
7. REPAIRS AND MAINTENANCE
The Tenant shall keep the Premises clean and in good condition. The Tenant shall be responsible for minor repairs up to KES 5,000. The Landlord shall be responsible for structural repairs and maintenance of fixtures.
8. TERMINATION
Either party may terminate this Agreement by giving 30 days' written notice to the other party. The Landlord may terminate immediately in the event of non-payment of rent, unlawful activity, or material breach of this Agreement.
9. GOVERNING LAW
This Agreement shall be governed by the laws of Kenya, including the Landlord and Tenant Act (Cap 301) and the Rent Restriction Act (Cap 296).
